Because the reality is that saves on optimal characters are so bloated on arelith that it is pretty much impossible to use regular DC spells.
This would be true if everyone had divine grace or dark blessing, but they don't. As you've been told in the past (viewtopic.php?f=36&t=24227&p=194892#p194892) getting flawless saves from gear, let alone good saves, is not as easy as it sounds without making some hefty sacrifices in other important areas.

It's possible, it just takes millions of gold to achieve. The dichotomy is that you can't spend millions of gold on gear that makes you immune to Balagarn's, which is what I would hope to be an obvious flaw in a spell that's level 1 or 2 or can simply be cast without limit.

All that being said I'm not sure why that's a "terrible argument" or, frankly, what this not-quite-factual piece of information you've posted really has to do with anything.
