sunken rentals still sailing?

second time now this happens to me, i rent a ship, go aboard, and i looks like its underwater
first ship had 0% hull, i was able to fix it and sail it. second one was the rental from UD , 100 % hull but also submerged
Steps to reproduce
----------------------------
rent a sunken rental, board it, type -ship to check hull
Expected result
-----------------------
you should not be able to board a sunken ship? they should be sunk till reset as far as i know
Actual result
-------------------
you are able to repair and sail them onec more, but you look like a submarine ....
