Shadovar Guardian: Persuade fails under Charm

Description of Bug Experienced:
(please include information of what you did, that lead up to the bug, what you expected to happen there, and what actually happened, then move on to describe below:)
Speaking to the two shadovar guardians that guard that building and need a persuade or intimidate check to speak on it. Doing a successful Charm Person on them doesn't pass the persuasion.

Steps to reproduce the Bug:
Cast Charm Person as a Epic Spell Focus:Enchantment user.
Guardian fails the check
Speak and try to persuade them

Expected Result:
The Persuade check passes and you can move on in the conversation.

Actual Result:
The check fails if you fail in the skill check, with no apparent effect.

Additional Information/Notes
It's my understanding that NPC persuade checks will pass with Charm Person cast from an Epic Enchantment caster, as one of the features that was supposed to replace Enchantment's loss of enchanting power.
