Earl Manfried's Defective Lichdom

Upon fighting Earl Manfried, I have at many occasions noticed him die even with the Phylactery unharmed. At first I thought it only happened when the Earl was killed with a healing spell/lay on hands, but recently, He died to a normal swing of a blade, despite the phylactery being unharmed.
Steps to reproduce
----------------------------
Stab the Earl.
Expected result
-----------------------
Survival until the phylactery is destroyed, as per usual with any lich
Actual result
-------------------
Falls and dies like the defective lich that he is.
